Terms & Conditions

These terms & conditions are entered into by & between Unity Functional Fitness Ltd

(Hereinafter: “Unity Fitness”) & You (hereinafter: “The Member”).

 

Services:

​

  • The membership you have signed up for entitles you to use all of Unity Fitness’s Equipment & Services available therein (unless specified). The membership gives you access to all Unity Fitness’s Sites (unless specified otherwise).

Memberships:

​

  • The membership you subscribe to (memberships Agreement) is a Personal Membership & for the sole use of the person assigned to it & can not be shared with anyone else.

  • Age: Each member confirms that they are 18years + / members aged 16-18 years will require written consent from their parent / guardian. Children under 14 years must be supervised at all times.

Health:

 

Prior to training with our facility participants will be asked to fill in the following:

  • Par-Q (Health Declaration), which confirms that he/she is not suffering with any health problems that would hinder them participating or engaging in exercise or that would be detrimental or adverse to their own health. If there are any doubts then the participant will be asked to seek medical advice from a professional, who will be able to confirm whether it is safe for she/he to exercise.

  • A Informed & Liability Waiver along with a Registration form will also be required. The registration Form allows for a next of kin & their contact details in the event of an emergency.

  • Unity Fitness shall have no obligation but to perform a fitness test (1-2-1 Assessment) or similar to determine the participants condition. Any assessments performed at Unity Fitness, is for the sole use of compiling comparative data in order to track the members progress in a programme & not for diagnostic purposes.

 

Liability:

​

  • Each member at Unity Fitness shall be liable for any property damage and/or personal injury caused by the member on the Unity Fitness Premises.

  • It shall be the responsibility/ obligation of the member to pay for any costs involved upon presentation of a statement thereof.

  • Waiver of Liability: Any & all use of the Unity Fitness facilities shall be at members own risk at all times. The member shall not utilise any equipment unless he/she knows the appropriate usage & can perform the movement safely. Unity Fitness shall not be liable for any injuries, physical impact or damage to the member, or the property of the member, or be subject to any claim arising out of the use of the premises and/or of the equipment to the users.

Personal Belongings:

 

  • Within our social area pigeon holes will be provided / available for members to keep their personal belongings in during a training session. All belongings need to be taken/ removed from the Premises after each session & the pigeon hole left empty for the remaining sessions. 

  • Unity Fitness will empty the pigeon holes on a daily basis & keep all lost property for a period of 1 month before disposal.

 

Lost Property / Theft:

 

  • Unity Fitness takes no responsibility for loss / damage or theft of any personal belongings. Any items left on the Unity Fitness premises will be kept for a period of 1 month before disposal.

 

Code of Conduct:

​

  • Each member shall respect the behavioral & operating principles embedded by Unity

    Fitness & laid out in our code of conduct.

  • If a member should so happen to breach our code of conduct then he/she will have

    their membership suspended or terminated at the Owner / managements (Lisa Cannon) sole discretion.

Access & Security:

​

  • Unity Fitness is open Monday - Friday 6am-8.30pm / Saturday 9.30am-12.30pm / Sundays are currently closed, with the exception of bank Holidays, Events & exceptional circumstances (When times may vary, the gym may close).

  • Classes are run at the times stated on our website â€‹www.unity-fitness.co.uk​ & our booking system.

  • Classes & Coaches are subject to change with no prior notice.

 

Payment:

​

  • The member is responsible for their own payment of their own membership. This is true even if the amount is debited directly by us Unity Fitness.

  • Agreed prices only apply if the member pays according to the agreed conditions.

  • Annual Subscription is based on 3monthly / 6monthly or 12monthly: the first months payment or pro-rata amount are paid at the point of this agreement. The following months payment will be paid on the 1st a month in advance.

  • The member is responsible for all payments, also in the case of automatic debits by Unity Fitness. If payment is late / does not process an email reminder will be sent to the member & access to the facility may be suspended (the membership at this point will still be active.). If after 30 days the amount is still not paid, the member is in violation of their agreement / contract & the total outstanding amount of the contract will be due. Unity Fitness may transfer the case to a debt collector, which will incur additional fees.

  • Monthly memberships, pay as you go, pro-rata amounts & any sign-up fees are paid at the point of this agreement. The member has given their approval for an automatic debit from his/her account or card.

  • Any cancellation/termination of this agreement must be announced a minimum of one month before the next debit is due.

Satisfaction Guarantee:

​

  • During 7 days from the start of the membership, the member can cancel his/her membership free of charge and will be reimbursed in full if we cannot provide the service we deemed to provide.

 

Renewal / Cancellation:

​

  • Annual Membership (3/6/12 monthly prepaid or subscription): The contract runs for the set period, during which time it cannot be cancelled. At the end of the contract period, the membership will roll onto a monthly rolling contract with a 30 day notice period to cancel the policy.

  • Cancellations must be sent via email to: â€‹unityfitnessmain@gmail.com​ & will not be actioned if sent via text etc. Unity Fitness will send a reminder via email one month before the end of the contract period. The member is responsible for his/her own cancellation, even if the email reminder was not received / landing in a junk/or spam box.

  • Monthly Memberships: The membership extension is triggered by the payment of a subsequent month. If no payment is done, the membership stops at the end of the contracted month. If the member has opted for a direct debit from an account or card, the cancellation must be announced at the latest one month before the end by sending an email to: â€‹unityfitnessmain@gmail.com​

  • Exceptional Cancellations: Exceptional Cancellations are granted if the member moves more than ten miles away from the Unity Fitness facility, on presentation of an official document to prove change of address. It is also possible to cancel the membership due to medical reasons, upon presentation of a medical certificate.

Price Changes:

 

  • All prices are fixed for the duration of the current annual subscription / membership. Any price changes will be communicated a minimum of 1 month prior to  implementation.

​

Membership Discounts:

​

  • Discounts on memberships may be offered & are at the sole discretion of the management. All discount changes will be communicated a minimum of 1 month prior to implementation or cancellation.

​

Frozen Membership:

​

  • It is possible to freeze annual subscription (12 monthly contracts only) i.e through injury or pregnancy, with the frozen time period added onto the end of the membership period (12 months). Twelve consecutive monthly payments will still be made according to the membership agreement.
